THE TERMS

Straight Answers. In Order.

1. Eligibility
The Services are for adults 18 and older. By using them, you're telling us you're at least 18. The Community and certification programs are intended for current and retired sworn law enforcement officers and their immediate family. We can verify eligibility and deny, suspend, or terminate access if criteria aren't met or if false information is provided during registration or verification.
2. Accounts
You're responsible for keeping your account credentials confidential and for anything that happens under your account. Give us accurate info at signup, keep it updated, and let us know right away if you spot unauthorized use.
3. The Police Speak Community
The Community is a peer-to-peer space for verified LEOs and immediate family. By participating, you agree to: treat other members with respect (no harassment, discrimination, or abuse); not share another member's identity, posts, or personal info outside the Community without consent; not solicit business, recruit for outside organizations, or drop unrelated commercial content; not post anything unlawful, threatening, or that discloses another person's confidential law enforcement information (like active investigation details or PII about civilians); and understand the Community is not a substitute for your department's official reporting channels, EAP, or emergency services. We can remove content or suspend/terminate access at our sole discretion for violations.
4. Certifications: RFA, HART, and CReW
RFA, HART, and CReW are training and certification programs built on the PR6 Resilience Model, licensed to Police Speak by Hello Driven Pty Ltd (Driven Labs). By enrolling, you agree to: complete coursework honestly and in good faith, including assessments, tasks, or practical demonstrations; understand that certification is awarded at Police Speak's discretion based on satisfactory completion; not share, copy, distribute, or reproduce course materials, videos, scripts, or assessment content outside the Services without our prior written consent; and use your credential accurately — RFA and HART are peer support and personal resilience credentials, not clinical or medical qualifications. CReW is a department-level certification. When an agency enrolls, additional terms specific to that engagement (a signed proposal or SOW) will govern the scope of services and take precedence over these Terms for that engagement.
5. Not a Substitute for Professional Care
Police Speak provides peer support, resilience education, and training content. It is not a substitute for professional medical, psychiatric, psychological, or legal advice, diagnosis, or treatment. Nothing in the App creates a therapist-client, physician-patient, or other clinical relationship. If you're in a mental health crisis, contact 988 (Suicide & Crisis Lifeline), COPLINE at 1-800-267-5463, text HOME to 741741, or emergency services. Always seek the advice of a qualified health provider for any medical or mental health questions.
6. Payments, Subscriptions, and Refunds
Certification programs (RFA, HART, CReW) are a one-time fee that unlocks the course materials. The Community is a recurring subscription, billed on the schedule shown at checkout, and renews automatically until cancelled. You can cancel the Community anytime — cancellation takes effect at the end of the current billing period, and you keep access until then. All sales are final. Because certification access is granted immediately upon purchase, no refunds will be issued once course access has been granted, except where required by law. CReW agency engagements are governed by the payment terms in the applicable signed proposal or invoice. Payments are processed by a third-party processor — we don't directly store your full payment card information.
7. Intellectual Property
All content within the Services — course materials, videos, scripts, assessments, the ALL Protocol, the ANCHOR system, trademarks, and the Police Speak name and logo — is owned by Police Speak or its licensors and protected by copyright, trademark, and other IP laws. The PR6 Resilience Model is licensed to Police Speak by Hello Driven Pty Ltd (Driven Labs) and remains the IP of its owner. You get a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial use. You may not copy, reproduce, distribute, publicly perform, modify, or create derivative works from any content in the Services without our prior written consent. Content you post in the Community stays yours, but by posting it you grant Police Speak a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content within the Services to operate and promote the Community.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PARTICULAR OUTCOME (INCLUDING IMPROVEMENT IN RESILIENCE, WELLBEING, OR JOB PERFORMANCE) WILL RESULT FROM USE OF THE SERVICES.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, POLICE SPEAK AND MICHAEL SIMPKINS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO POLICE SPEAK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Police Speak and Michael Simpkins from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another person, including other Community members.
11. Termination
We can suspend or terminate your access at any time, with or without notice, for conduct that violates these Terms or that we believe is harmful to other users, Police Speak, or third parties. You can stop using the Services and cancel your account anytime. Sections that by their nature should survive termination (including Sections 7-13) will survive.
12. Dispute Resolution: Binding Arbitration
You and Police Speak agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration, not in court, except that either party can bring an individual claim in small claims court if it qualifies. Class action waiver: Any arbitration or claim will be on an individual basis only — not as a class, collective, or representative action. You waive any right to participate in a class action against Police Speak. Arbitration administration: Arbitration will be administered by a recognized arbitration organization (such as the American Arbitration Association) under its consumer rules, taking place in Tennessee or by remote means agreed to by the parties. Opt-out: You can opt out of this arbitration agreement by notifying us in writing at the contact info in Section 15 within 30 days of first accepting these Terms. If any part of this arbitration provision is unenforceable, the rest stays in effect, and any claim not subject to arbitration will be resolved exclusively in the state or federal courts located in Tennessee.
13. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of laws principles, except where superseded by federal law or the arbitration rules above.
14. Changes to These Terms
We may update these Terms from time to time. We'll post the updated version in the App and update the "Last updated" date at the top. Material changes will be communicated through the App or by email where appropriate. Continued use after any changes means you accept the updated Terms.
